Stel nu dat je als werknemer vindt dat er eigenlijk niet zoveel op je functioneren valt aan te merken? Als je dan het verbeterplan niet accepteert, loop je de kans dat de werkgever gelijk overgaat tot ontslag via de kantonrechter. De rechter zou kunnen oordelen dat de werkgever gelijk heeft met het aangeboden verbetertraject. Aan de andere kant: instemmen met een verbetertraject zou je later het verwijt kunnen opleveren dat je het wel eens was met de kritiek van je werkgever en dat je het er dus ook mee eens was dat je niet voldoende functioneerde. Verder is het raadzaam om je dan wel wat meegaand op te stellen en bereidheid tot verbetering te tonen, daar waar dat nodig is, maar dan buiten een verbetertraject. Ook zou je concreet in moeten gaan op wat de werkgever in het verbeterplan van je wil vragen. Bedenk daarbij dat (eventueel later) een rechter jouw standpunt wel degelijk zal meewegen bij zijn beoordeling, maar dat eigenwijsheid wordt afgestraft. Je werkgever mag zijn organisatie inrichten, zoals hem dat goeddunkt en mag maatregelen nemen als zaken niet goed lopen.
